RESOLUTION NO.   2014-4  

TOWN COUNCIL OF LEO-CEDARVILLE

RESOLUTION REGARDING THE PURCHASE OF REAL ESTATE

WHEREAS, The Town of Leo-Leo Cedarville wishes to purchase certain real estate in two tracts; and

WHEREAS, The first tract (hereinafter “Tract 1”) is described more particularly on Exhibit A;, and

WHEREAS, The second tract (hereinafter “Tract 2”) is described more particularly on Exhibit B; and

WHEREAS, The purchase price for each Tract shall be Twenty Four Thousand Five Hundred Dollars ($24.500.00)

NOW THEREFORE, be it resolved by the Town Council of the Town of Leo-Cedarville, Indiana that:

1.         The purchase of Tract 1 for the price of $24,500.00 is approved.

2.         The purchase of Tract 2 for the price of $24,500.00 is approved.

3.         John Clendenen is authorized and directed to execute all documents on behalf of the Town of Leo-Cedarville necessary to close the purchases.

CLIFTON TRACT

Part of the Northeast Quarter of Section 22, Township 32 North, Range 13 East, Allen County, Indiana. more particularly described as follows:

Commencing at the point of intersection of the centerline of Schwartz Road and the North line of the South 55 acres of the Northeast Quarter of Section 22, Township 32 North, Range 13 East, Allen County, Indiana; thence North 88 degrees 12 minutes 36 seconds East (recorded bearing and basis for this description) along the North line of the South 55 acres a distance of 37.14 feet to the East right of way line of Schwartz Road as described in a Warranty Deed recorded as Document 990035599, said point being the point of beginning; thence North 27 degrees 29 minutes 54 seconds East along the East right of way line a distance of 22.39 feet (22.22 feet, recorded) to a point of curve; thence Northeasterly along the East right of way line on a curve to the tight having a radius of 930.0 reet and subtended by a chord having a bearing of North 22 degrees 14 minutes 35 seconds East and a chord length of 229.56 feet, an arc distance of 230.15 feet: thence North 89 degrees 03 minutes 13 seconds East (North 88 degrees 56 minutes West, recorded) a distance of 416.7 feet; thence South 02 degrees 00 minutes 11 seconds East a distance of 223.06 feet to a point on the North line of the South 55 acres; thence South 88 degrees 12 minutes 36 seconds West (South 89 degrees 59 minutes 35 seconds West, recorded) along the North line of the South 55 acres a distance of 521.93 feet to the point of beginning, containing 2.46 acres.
