ORDINANCE NO. 2012-8
ALCOHOL SALES ENABLING ORDINANCE
WHEREAS, Indiana Code § 7.1-3-9-3 states that the legislative body of a city or town that has a population of less than five thousand (5,000) shall have the power and jurisdiction to enact an enabling ordinance consenting that liquor retailer’s permits may be issued to applicants in respect to premises located within the city or town; and
WHEREAS, the Town of Leo-Cedarville is a town of less than five thousand (5,000) residents; and
WHEREAS, the Leo-Cedarville Town Council has determined that it is appropriate at this time to allow liquor retailer’s permits to be issued by the Indiana Alcoholic Beverage Commission, or other legal authority, within the Town boundaries.
NOW THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF LEO-CEDARVILLE, INDIANA;
|1.||As authorized by I.C. 7.1-3-9-3, liquor retail permits may be issued to applicants in respect to premises locates within the boundaries of the Town of Leo-Cedarville.|
|2.||All parts of previous ordinances in conflict herewith are repealed to the extent of said conflict.|
|3.||In the event any section, subsection, clause, phrase or portion of this chapter is for any reason held illegal, invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remainder of this chapter. It is the legislative intent of the council that this chapter would have been adopted if such illegal provision had not been included or any illegal application had not been made.|
|4.||This Ordinance shall be in full force and effect upon its passage and publication in accordance with applicable law.|
