ORDINANCE  # 2012-4   OF THE TOWN COUNCIL OF
LEO-CEDARVILLE, INDIANA

AN ORDINANCE REGULATING THE TURNING OF VEHICLES ONTO AMSTUTZ ROAD WHEN EXITING THE CIRCLE DRIVE AT LEO-HIGH SCHOOL

WHEREAS, Indiana Code Section 9-21-1-3 allows the Town of Leo-Cedarville to regulate the flow of traffic, on highways and private roads and, specifically allows the Town to regulate or prohibit the turning of vehicles at intersections; and

WHEREAS, The Town Council for the Town of Leo-Cedarville has determined that an unsafe condition exists at the exit from the Circle Drive of Leo-High School onto Amstutz Road; and

WHEREAS, Indiana law allows the Town of Leo-Cedarville to establish a penalty for violations of its traffic control ordinances;

NOW, THEREFORE, IT IS ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF LEO-CEDARVILLE, ALLEN COUNTY, INDIANA:

Section 1.           Left Turns Prohibited:     No vehicle may make a left turn (i.e. South) when exiting the circle drive in front of Leo-High School onto Amstutz Road. Vehicles exiting the circle drive of Leo-High School shall only turn right (i.e. North) onto Amstutz Road.

Section 2.           Violations:     Any person operating a vehicle in violation of this ordinance shall be subject to a fine of not more than two hundred dollars ($200) for each violation.

Section 3.           Placement of Appropriate Signs:     No person shall be subject to any fine pursuant to Section 2, hereof, until a proper traffic control device or sign has been erected on such street or at such intersection. Any such sign shall comply with the requirements of the Indiana Uniform Traffic Control Devices Manual, if applicable.

Section 4.           All ordinances or parts of ordinances in conflict herewith are hereby repealed.

Section 5.           In the event any section, subsection, clause, phrase or portion of this chapter is for any reason held illegal, invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remainder of this chapter. It is the legislative intent of the council that this chapter would have been adopted if such illegal provision had not been included or any illegal application had not been made.

Section 6.           This ordinance shall be in full force and effect from and after its passage and approval by the Town Council, and after publication required by State law.
