ORDINANCE 2008-04 OF THE TOWN COUNCIL OF
LEO-CEDARVILLE, INDIANA

AN ORDINANCE FOR STORMWATER MANAGEMENT

 

WHEREAS, The Town of Leo-Cedarville is required to establish a regulatory mechanism for regulating stormwater quality management; and

WHEREAS, Phase II of the National Pollutant Discharge Elimination System (NPDES) requires permit coverage for stormwater discharges from regulated small municipal separate storm sewer systems (MS4s) and for small construction activity that results in the disturbance of equal to or greater than one acre; and

WHEREAS, in response to Phase II of NPDES, the Indiana Department of Environmental Management enacted Rule 12 (327 IAC 15-13) and revise Rule 5 (327 IAC 15-5); and

WHEREAS, the Town of Leo-Cedarville, as co-permittee, in conjunction with the Board of Commissioners of the County of Allen, sought and obtained the Phase II NPDES permit for stormwater discharges; and

WHEREAS, The Board of Commissioners of the County of Allen, has adopted Ordinance Nos. 4-25-08-07, 4-25-08-08 and 4-25-08-09, being Stormwater Management Ordinance, a fee schedule, and a Technical Standards Manual, all as part of Allen County Code Title 19 providing for the health, safety and general welfare of the citizens of Allen County through the regulation of stormwater and non-stormwater discharges to the storm drainage system and to protect, conserve and promote the orderly development of land and water sources within Allen County; and

NOW THEREFORE, BE IT ORDAINED that the Town Council of the Town of Leo-Cedarville does hereby adopt the reference and incorporate herein as a part of the Code of Ordinances of the Town of Leo-Cedarville, Indiana, as if fully set out at length herein, Allen County Code Title 19, Articles 1, 2, and 3, copies of which are appended here to as Exhibit “A”, “B”, and “C”, together with any amendments thereto, which collectively shall be the Stormwater Management Ordinance for the citizens of the Town of Leo-Cedarville, Indiana; and

BE IT FUTHER ORDAINED that the surveyor of Allen County is hereby designated as Leo-Cedarville’s representative to collect all fees and carry out all inspection, monitoring, and enforcement procedures necessary to ensure compliance with this ordinance; and

PASSED AND ADOPTED by the Town Council of the Town of Leo-Cedarville, Indiana on this   17th   day of June 2008.
