ORDINANCE 2007-05 OF THE TOWN COUNCIL OF
AN ORDINANCE REDUCING THE SPEED LIMIT ON HOSLER ROAD AND WAYNE STREETS IN THE VICINITY OF LEO ELEMENTARY SCHOOL
WHEREAS, Indiana Code Section 9-21-1-3 allows the Town of Leo-Cedarville to regulate the flow of traffic, to alter speed limits, and to designate intersections as stop or yield intersections within the Town’s corporate borders; and
WHEREAS, Indiana Code Section 9-21-5-6 allows the Town to establish a reduced speed on a highway in the vicinity of a school; and
WHEREAS, The Town Council for the Town of Leo-Cedarville has determined that the general speed limit established by state law along Hosler Road and Wayne Street around the Leo Elementary School is greater than what is reasonable and safe; and
WHEREAS, Indiana law allows the Town of Leo-Cedarville to reduce the speed limit in the vicinity of a school to not less than twenty (20) miles per hour; and
WHEREAS, Indiana law allows the Town of Leo-Cedarville to establish a penalty for violations of its traffic control ordinances;
NOW, THEREFORE, IT IS ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF LEO-CEDARVILLE, ALLEN COUNTY, INDIANA:
Section 1. Establishment of Designated School Zone: There is hereby designated a school zone for purposes of establishing a reduced speed limit within the Town of Leo-Cedarville, Indiana, around the Leo Elementary School. Specifically, this designated school zone is established along Hosler Road between Amstutz Road and Wayne Street; and along Wayne Street between Hosler Road and State Road 1.
Section 2. Speed Limit Established: No person may drive a vehicle greater than twenty-five (25) miles per hour within the Designated School Zone during the period between 7:30 a.m. and 8:30 a.m. and between 2:00 p.m. and 3:00 p.m.
Section 3. Sign Postings: Signs designating the reduced speed limits and relevant times shall be posted as follows:
On Hoser, 172′ East of the Wayne Street & Hosler Street Intersection.
On Wayne, 15′ South of the Wayne Street & Hosler Street Intersection.
On Wayne, 15′ North of the Wayne Street & SR1 Intersection.
Section 4. Violations: Any person operating a vehicle in violation of this ordinance shall be subject to a fine of not more than five hundred dollars ($500) for each violation.
Section 5. Placement of Appropriate Signs: No person shall be subject to any fine pursuant to Section 4, hereof, until a proper traffic control device or sign has been erected on such street as specified in Section 3 above. Any such sign shall comply with the requirements of the Indiana Uniform Traffic Control Devices Manual, if applicable.
Section 6. All ordinances or parts of ordinances in conflict herewith are hereby repealed.
Section 7. In the event any section, subsection, clause, phrase or portion of this chapter is for any reason held illegal, invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remainder of this chapter. It is the legislative intent of the council that this chapter would have been adopted if such illegal provision had not been included or any illegal application had not been made.
Section 8. This ordinance shall be in full force and effect from and after its passage and approval by the Town Council, and after publication required by State law.
