ORDINANCE 2007-04 OF THE TOWN COUNCIL OF
AN ORDINANCE AUTHORIZING CITATIONS ISSUED BY THE COMMUNITY RESOURCE OFFICER TO BE ADJUDICATED AND ENFORCED IN THE CITY COURT OF NEW HAVEN, INDIANA, AND ALL OTHER COURTS OF COMPETENT JURISDICTION
WHEREAS, the Town of Leo-Cedarville (the “Town”) has entered into a Law Enforcement Services Agreement (the “Agreement”) with the County of Allen (the “County”) for the provision by the County of a sworn Deputy Sheriff (the “Community Resource Officer”) to render law enforcement services to the Town; and
WHEREAS, the Agreement provides that the Community Resource Officer shall issue citations for violations of Town ordinances pertaining to noise control, open fires, public nuisances, parking, abandoned vehicles, park regulations, and control of animals;
NOTWITHSTANDING either enforcement provisions specifically set forth in the Code of Ordinance; and
WHEREAS, the Town desires to adjudicate and enforce citations issued by the Community Resource Officer in the City Court of New Haven, Indiana, and all other courts of competent jurisdiction;
NOW, THEREFORE, BE IT ORDAINED by the Town Council of the Town of Leo-Cedarville, Indiana:
1. That the Code of Ordinances of the Town be amended to add to Chapter 10 the following:
A. Notwithstanding other enforcement provisions specifically set forth in the Code of Ordinances, the Town Community Resource Officer may issue citations for violations of ordinances as authorized by the Law Enforcement Services Agreement between the Town and the Allen County Sheriff.
B. All citations issued under proper authority by the Town Community Resource Officer may be adjudicated and enforced in the City Court of New Haven, Indiana, or any other court of competent jurisdiction.
C. Enforcement by citation shall be alternative to any specific enforcement provisions set forth in any specific ordinance or otherwise set forth in this Code.
2. This ordinance shall become effective upon its passage and upon its execution by the Town Executive as attested by the Clerk-Treasurer.
