ORDINANCE 2007-02 OF THE TOWN COUNCIL OF
LEO-CEDARVILLE, INDIANA

WHEREAS, Indiana Code 9-21-1-3 allows the Town of Leo-Cedarville to regulate the flow of traffic, to alter speed limits, and to designate intersections as stop or yield intersections within the Town’s corporate boarders; and

WHEREAS, the Town Council for the Town of Leo-Cedarville has determined that the general speed limit established, on Amstutz Road between State Road 1 and Hosler Road, is greater than what is reasonable and safe; and

WHEREAS, Indiana law allows the Town of Leo-Cedarville to reduce the speed limit on Amstutz Road to thirty (30) miles per hour; and

WHEREAS, Indiana law allows the Town of Leo-Cedarville to establish a penalty for violations of its traffic control ordinances;

NOW, THEREFORE, IT IS ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF LEO-CEDARVILLE, ALLEN COUNTY, INDIANA:

Section 1.     Within the Town of Leo-Cedarville, Indiana, no person may drive a vehicle greater than thirty (30) miles per hour on Amstutz Road between State Road 1 and Hosler Road.

Section 2.     Violations: Any person operating a vehicle in violation of this ordinance shall be subject to a fine of not more than five hundred dollars ($500) for each violation.

Section 3.     Placement of Appropriate Signs: No person shall be subject to any fine pursuant to Section 2, hereof, until a proper traffic control device or sign has been erected on such street or at such intersection. Any such sign shall comply with the requirements of the Indiana Uniform Traffic Control Devices Manual, if applicable.

Section 4.     All ordinances or parts of ordinances in conflict herewith are hereby repealed.

Section 5.     This ordinance shall be in full force and effect from and after its passage and approval by the Town Council, and after publication required by State Law.
