ORDINANCE NO. 2006-14
AN ORDINANCE ASSERTING THE
JURISDICTION OF THE TOWN OF LEO-CEDARVILLE
WITHIN ITS BOUNDARIES
Whereas, The Board of Commissioners of Allen County has adopted its Ordinance #11-22-06-25 restricting the use of tobacco within the County; and,
Whereas the County Ordinance #11-22-06-25, by its terms, would otherwise become effective within the Town of Leo-Cedarville, June 1, 2007; and,
Whereas, The Common Council of the Town of Leo-Cedarville has determined that it is not in the best interest of the Town of Leo-Cedarville for this Ordinance to take affect within the Town at this time;
NOW THEREFORE, BE IT ORDAINED by the Common Council of the Town of Leo-Cedarville that the Town of Leo-Cedarville Code shall be amended to read as follows:
COUNTY ORDINANCE NOT EFFECTIVE WITHIN TOWN LIMITS
The Town of Leo-Cedarville hereby opts out of Allen County Ordinance #11-22-06-25, adopted by Allen County, Indiana regulating or restricting the use of tobacco, and such ordinance shall not apply within the boundaries of the Town of Leo-Cedarville except to the extent required by a Town Ordinance or an Act of the State Legislature.
This Ordinance shall be in full force and effect after its passage and any approvals or publications as may be required by law.
Passed and adopted by the Town Council of the Town of Leo-Cedarville, Indiana on this 19th day of December , 2006.
