ORDINANCE   2004-07   OF THE TOWN COUNCIL OF
LEO-CEDARVILLE, INDIANA

WHEREAS, Indiana Code Section 9-21-1-3 allows the Town of Leo-Cedarville to regulate the flow of traffic, to alter speed limits, and to designate intersections as stop or yield intersections with the Town’s corporate borders; and

WHEREAS, The Town Council for the Town of Leo-Cedarville has determined that the general speed limit established by state law for residential districts within the Town is greater than what is reasonable and safe; and

WHEREAS, Indiana law allows the Town of Leo-Cedarville to reduce the speed limit in residential districts to not less than twenty (20) miles per hour; and

WHEREAS, Indiana law allows the Town of Leo-Cedarville to establish a penalty for violations of its traffic control ordinances;

NOW, THEREFORE, IT IS ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF LEO-CEDARVILLE, ALLEN COUNTY, INDIANA:

Section 1.       Speed Limits Within Residential Districts:   Within the Town of Leo-Cedarville, Indiana, no person may drive a vehicle greater than twenty (20) miles per hour in any residential district.

Section 2.       Definition of Residential Districts:   For purposes of this ordinance, the term “Residential Districts” shall mean territory contiguous to and including a street, when the property on the street for a distance of at least five hundred (500) feet is primarily improved with residences and not comprising a business district.

Section 3.       Speed Limits on Certain Roads:   Within the Town of Leo-Cedarville, Indiana, no person may drive a vehicle greater than twenty (20) miles per hours on any of the following streets:

Section 4.       Violations:   Any person operating a vehicle in violation of this ordinance shall be subject to a fine of not more than five hundred dollars ($500) for each violation.

Section 5.       Placement of Appropriate Signs:   No person shall be subject to any fine pursuant to Section 4, hereof, until a proper traffic control device or sign has been erected on such street or at such intersection. Any such sign shall comply with the requirements of the Indiana Uniform Traffic Control Devices Manual, if applicable.

Section 6.   All ordinances or parts of ordinances in conflict herewith are hereby repealed.

Section 7.    In the event any section, subsection, clause, phrase or portion of this chapter is for any reason held illegal, invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remainder of this chapter. It is the legislative intent of the council that this chapter would have been adopted if such illegal provision had not been included or any illegal application had not been made.

Section 8.      This ordinance shall be in full force and effect from and after its passage and approval by the Town Council, and after publication required by State law.
