ORDINANCE   2003-04   OF THE TOWN COUNCIL OF
LEO-CEDARVILLE, INDIANA

AN ORDINANCE REVISING THE LEO-CEDARVILLE ZONING ORDINANCE TO PROVIDE FOR THE SALE OF FIREWORKS WITHIN CERTAIN ZONING DISTRICTS WITHIN THE BOUNDARIES OF THE TOWN OF LEO- CEDARVILLE, INDIANA

WHEREAS, the Town of Leo-Cedarville Zoning Ordinance does not specifically provide for the sale of fireworks within the Boundaries of the Town of Leo-Cedarville; and

WHEREAS, the Leo-Cedarville Town Council has determined that the sale of fireworks should be zoned in a manner consistent with the Leo-Cedarville Comprehensive Plan and the health, safety and welfare of the general public.

NOW, THEREFORE, BE IT ORDAINED by the Town Council of the Town of Leo-Cedarville, Indiana that the Leo-Cedarville Zoning and Ordinance be revised as follows:

1.       Article Four, Section 4.7, “Cl” District: add “fireworks sales” as a Special Exception Use under the heading of “Business: Recreation” immediately after “adult uses”.

2.       Article Four, Section 4.9, “C2” District: add “fireworks sales” as a Permitted Use under Business Recreation immediately after “adult uses.”

3.       Article Eighteen, Section 18.2 Definitions: add “Fireworks: any composition or device designed for the purpose of producing a visible or audible effect by combustion, deflagration, or detonation. Fireworks consist of all common fireworks and special fireworks as defined under IC 22-11-14-1.”

This ordinance shall repeal any prior ordinance inconsistent with its terms.

This ordinance shall become effective upon its passage and upon its execution by the Town Executive (i.e. Town Council President) as attested by the Clerk-Treasurer.

Passed and adopted by the Town Council of the Town of Leo-Cedarville, Indiana on this   20   day of   May  , 2003.
